  • When you make a purchase of one of our products: We may collect your name, driver’s license or state ID number or other similar identifier, Social Security number, payment card number, expiration date and CVV from you utilizing a third-party application (e.g., Plaid.).   • If you ask us to send you promotion and marketing information and special offers: We may collect your name, date of birth, email address, and phone number from you;

This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. You agree that any claim for or award of attorneys’ fees, including such claim or award pursuant of Chapter 38 of Texas Civil Practice and Remedies Code, is waived. To the fullest extent permitted by applicable law, NO ARBITRATION OR OTHER CLAIM UNDER THESE TERMS SHALL BE JOINED TO ANY OTHER ARBITRATION OR CLAIM, INCLUDING ANY ARBITRATION OR CLAIM INVOLVING ANY OTHER PROCEEDINGS SHALL BE PERMITTED. If THIS CLASS ACTION WAIVER is deemed unenforceable, then any putative class action may only proceed in a court of competent jurisdiction and not in arbitration. The parties agree to waive any right to a jury trial in claims or disputes between the parties, whether any such claim is in arbitration or in court.

In no event shall any claim, action or proceeding by you related in any way to these Terms be instituted more than two (2) years after the cause of action arose.

12. BINDING EFFECT. These Terms shall be binding upon and inure to the benefit of the parties thereto and their respective heirs, representatives, successors, and assigns.

13. TERMINATION. These Terms shall remain in force and effect until terminated by Perry Homes. In the event of termination of this Agreement, all restrictions imposed upon you herein, including all disclaimers, waivers, releases, and limitations of liability, shall survive.

14. REVISIONS. Company may from time to time revise this Agreement. By using this Site, you agree to be bound by any such revisions and should therefore, periodically visit this page to determine the then current Agreement and Terms of Use to which you are bound. Because of the frequency of updates and changes and the possibility of errors, nothing on the Site may be used as evidence in any legal proceeding, investigation, or arbitration without Company’s express written consent. Company has the right to stop conduct on the Site that it deems offensive or that it determines to inhibit the ability of others to use the Site.
